Waring’s Creek Improvement Association (WCIA) is challenging Prince Edward County’s recent approval of the draft plan of the Cold Creek development.
In a press release, WCIA says they have served notice of the legal challenge to the municipality, claiming that council did not have legal authority to make this decision as the matter was under appeal by Cold Creek at the Ontario Land Tribunal when the decision was made.
The plan for the subdivision was first put before council in fall 2024, and was rejected. The Cold Creek developer appealed that refusal to the Ontario Land Tribunal. While the matter was before the tribunal, the county reconsidered the application with modifications, and voted to approve it with conditions. The WCIA says that due to the matter still being before the land tribunal, council lacked the authority to act on the file, and breached the Planning Act.
Waring’s Creek Improvement Association has opposed the development previously, citing concerns about insufficient environmental studies, and the development’s effects on the creek and its aquifer.
