Lehigh Cement Limited now faces five charges under the Occupational Health and Safety Act.
Three people were injured in the September 7, 2021 incident, with two of them being airlifted to hospital in Toronto.
The charges read that as an employer the company failed to:
- Count 1: provide information, instruction and supervision to a worker to protect the health or safety of the worker at a workplace located at 1370 Highway 49, Picton, Ontario contrary to subsection 25(2)(a) of the Occupational Health and Safety Act, R.S.O. 1990, c. O.1, as amended;
- Count 2: take every precaution reasonable in the circumstances for the protection of a worker at a workplace located at 1370 Highway 49, Picton, Ontario contrary to subsection 25(2)(h) of the Occupational Health and Safety Act, R.S.O. 1990, c. O.1, as amended;
- Count 3: acquaint a worker or a person in authority over a worker with any hazard in the work and in the handling, storage, use, disposal and transport of any article, device, equipment or a biological, chemical or physical agent at a workplace located at 1370 Highway 49, Picton, Ontario contrary to subsection 25(2)(d) of the Occupational Health and Safety Act, R.S.O. 1990, c. O.1, as amended;
- Count 4: ensure that the equipment, materials and protective devices provided by the employer are maintained in good condition at a workplace located at 1370 Highway 49, Picton, Ontario contrary to subsection 25(1)(b) of the Occupational Health and Safety Act, R.S.O. 1990, c. O.1, as amended;
- Count 5: ensure that the provisions of subsection 62(1)(c) of Ontario Regulation 851/90 were complied with at a workplace located at 1370 Highway 49, Picton, Ontario contrary to subsection 25(1)(c) of the Occupational Health and Safety act, R.S.O. 1990, c. O.1, as amended;
The matter goes to Picton court on December 16.
