The trial of an Oshawa man, charged after a fatal accident northeast of Tweed, has been told he could have been driving in his sleep.
Forty-seven-year-old William Spears was charged with criminal negligence causing death and criminal negligence causing bodily harm after a van crashed into a motorcycle on Highway seven, 10 kilometres west of Kaladar in August, 2006.
A man from Almonte died in the accident, and his wife, on another motorcycle, was injured.
A psychiatrist and sleep disorders expert testified in Kingston court Spears was diagnosed last year with sleep apnea, a condition in which breathing stops while sleeping and the person can be sleep deprived.
The trial continues.
