Officers from the Peterborough OPP have charged an individual with impaired while driving on their own property.
On Tuesday September 2, 2025 shortly after 1:30 p.m., Peterborough County OPP officers attended a residence on Heritage Line in Otonabee-South Monaghan Township in relation to a neighbour dispute call. Upon arrival, officers were advised that the individual they were looking to speak with was currently driving a vehicle on the property. Officers located the vehicle and upon speaking with the driver, determined him to be under the influence of alcohol. The individual was arrested and transported to the Peterborough County OPP detachment for further testing.
James McCloskey (age 71) of Otonabee-South Monaghan, ON., was arrested and charged with:
• Operation while impaired
• Failure or refusal to comply with demand
The accused had his driver’s licence suspended for 90 days, and vehicle impounded for seven days.
The accused is scheduled to appear before the Ontario Court of Justice in Peterborough on October 7, 2025.
The Criminal Code of Canada does not distinguish between public and private property when it comes to the impaired operation of a motor vehicle. A motor vehicle is also not limited to cars and trucks but can also include snowmobiles, ATVs, lawn tractors, golf carts, e-bikes, and other vehicles that are not purely human-powered.
