Northumberland OPP officers have charged a driver, after the driver refused to provide a breath sample during an impaired driving investigation.
Officers were responding to a call for a vehicle driving erratically on Highway 401 near Port Hope on Saturday, just after 10 a.m.
The complaint originated from the Toronto area, where witnesses said an SUV hit the concrete centre barrier before running across three lanes of traffic. Police located an SUV matching the vehicle’s description with damage to its driver’s front side, but the driver was not with the vehicle.
Police found the driver at the address the vehicle was registered to. When police arrived, they smelled alcohol on the driver’s breath, and he was displaying other signs of impairment. Police demanded a breath sample for a screening device, but the driver refused.
Marley Callow, age 35, of Warkworth has been charged with failure or refusal to comply with demand, operation while impaired, and dangerous operation.
The accused is scheduled to appear at the Ontario Court of Justice in Cobourg.
Northumberland OPP are reminding the public that failing to provide a suitable sample of breath upon an officer’s demand carries the same consequences as a charge of operation while impaired, and operation while impaired with blood alcohol over 80.
