A sentencing date has been set for Constable Jeffrey Smith.
The date has been set for March 28, 2024 at 10 a.m.
Smith was found guilty of assault in the 2019 arrest of Mario Baptiste Jr. inside a Taco Bell.
Smith, along with Constable Paul Fyke, was initially charged with assault causing bodily harm.
Fyke was found not guilty.
Constable Kyle Dodds had also faced a similar charge but Crown Prosecutor Ian Bulmer withdrew the charge before the trial began.
The arrest was made following an off-duty investigation by Constable Fyke into a stolen drink from the former Lowe’s location on Millennium Parkway, now a RONA+ leading to the arrest of Mario Baptiste Jr. inside a Taco Bell on North Front Street.
Baptiste Jr. is suing the Belleville Police Service, former Chief of Police Ron Gignac and Constables Paul Fyke, Jeffrey Smith, Kyle Dodds and Jill McAuley over the incident.
The civil lawsuit totals $550,000.
