The City of Belleville’s Planning Advisory Committee has denied an amendment to a zoning by-law that would allow a property to have a depot for a property maintenance business and to sell bulk landscaping materials.
Discussion of the amendment followed a by-law enforcement complaint of these uses being done informally.
The land is currently being used for agriculture.
Concerns arose from CN Rail who has three sets of rail lines around the area, including its main line.
The company cited safety concerns, specifically when it came to left or right turns to merge onto Airport Parkway where the land is located.
This despite receiving a Rail Crossing Safety Report from the applicant.
Most recently, on January 20, 2023, city staff received correspondence from CN Rail to the applicant with more mitigative actions that CN Rail expects at the rail crossing.
The committee denied the zoning by-law amendment with the report from city staff stating that the applicant would need to enter a crossing agreement and submit a crossing assessment for any change of use to the property.
