A Belleville man has been found “not responsible” for the stabbing death of his mother because of a mental health disorder.
The decision in the case of Skylar Oliveira, charged with the stabbing death, was handed down in a Belleville court late Wednesday.
The court sent Oliveira immediately back to Providence Care Hospital, to the Care Forensic Unit, on Wednesday evening where he has been in care for a number of months.
Testimony presented to the court indicated that Oliveira has autism spectrum and insane automatism and was considered not responsible for his actions.
The assault and death occurred August 22, 2020.
During the altercation his mother, who also had a knife, ran to a neighbouring house where she was followed by Oliveira and stabbed.
Police were called to the scene just before 2 a.m. that Saturday morning.
The court heard that Oliveira suffered a stabbing as well in the altercation.
A doctor’s report indicated he remains a significant threat to the public, given his condition with a “mental disorder and an autism disorder.”
The report indicated he “suffers the disorder and was the cause of the event.”
The court heard there were a number of factors that led up to the incident on the porch of residence on Burnham St.
It heard that Oliveira stabbed his mother repeatedly that night causing her death, and the issue was whether he committed a voluntary act or was not criminally responsible.
Reports to the judge indicated Oliveira has psychiatric disorders as well as ADHD and Acute Stress Response.
