Ontario’s Special Investigations Unit says it won’t be laying criminal charges in connection to an incident at Presqu’ile Park last summer, where a cyclist suffered a separated shoulder after crashing into an unmarked police cruiser.
The incident happened on the morning of June 27, 2020 when the cyclist hit the cruiser on its passenger side, as it was turning right into the Presqu’ile Park Nature Centre.
The man was treated in hospital for a possible separated shoulder.
In his report, SIU Director Joseph Martino says while he is “satisfied on the evidence that the subject officer is responsible” for the crash, he didn’t feel that the officer’s actions met the qualifications for a charge of dangerous driving causing bodily harm.
He says the officer likely thought the bike was going slower than it was, when he started to turn, calling his decision “a momentary lapse of care”, but not a criminal offence of willingly driving dangerously.
