The Municipality of Prince Edward has made the legal opinion on a controversial rezoning in Picton public.
Following council’s approval of a motion from Councillor Phil St-Jean asking to make the legal opinion public in an effort to remain transparent to the residents of Prince Edward County, the document was released mid-afternoon on Wednesday.
The opinion was in relation to a rezoning from Tourist Commercial to Special Tourist Commercial at 28 Fairfield Street in Picton.
The four page opinion from D. Wayne Fairbrother stated “there is no reasonable or supportable basis for council to refuse the requested rezoning.”
The summary continued on to state “the legal tests for approving the proposed zoning amendment have been met.”
Council approved the rezoning amendment at their meeting on August 13 with a 9-4 vote.
