A legal action surrounding the use of Picton Terminals is headed to the Ontario Court of Appeal.
Save Picton Bay is appealing an Ontario Superior Court decision this past summer, which ordered the company to remove portable industrial equipment and aggregate stockpiles from the northeast portion of its Picton Bay site, but exempted other parts of the property under legal non-conforming status.
The group is asking the court of appeal to throw out the original decision and to rule that the current use of the Picton Terminals site not be permitted.
It also asks that The County be on the hook for all costs associated with the appeal.
Save Picton Bay Director Victor Lind says it is expected to take about six months before the appeal is heard.
