A Marmora man has been sentenced to serve five and a half years in a federal penitentiary after being convicted of child pornography charges.
In October 2016, the 41-year-old man who cannot be named under a publication ban, pleaded guilty to making child pornography, possessing child pornography, sexual touching and voyeurism.
During the trial court heard how the man was found to be taking inappropriate photos of his young niece and touching her while she was sleeping.
The incidents date back to 2005, when the girl was between the ages of 11 and 13 years old.
Investigators became aware after the accused lent a CD to a friend, which contained images of adult pornography, along with photos of the girl.
On Monday, Justice Stephen Hunter handed down his decision that included a DNA order, added to the Sexual Offenders Registry for life, a non-communication order with the victims, he has to pay an $800 victim surcharge and he has to stay away from where children under the age of 16 frequent. Sentencing was pushed back to allow for lawyers to consider a sexual behaviour report. The report indicated the man was at a moderate to high risk of re-offending sexually.
Hastings County Crown attorney Lee Burgess says he thinks Justice Hunter has come to a good conclusion given the circumstances.
He was given a credit for one year and two months time already served. That leaves four years and four months left to serve of his sentence.
