The conviction of the owner of the former Bakelite property in Belleville on Environment Ministry charges has been upheld.
Justice Rommell Masse released his decision yesterday, rejecting the appeal of the convictions of Jim Sinclair and his two companies related to work he did at the Dundas Street East property.
Masse said Sinclair totally disregarded lawful Orders of the Provincial Officers, the ministry’s regional director and the court.
Sinclair appealed a four-month jail sentence and 695-thousand dollars in fines late last year, and although the fines were reduced by 60-thousand dollars, jail time is expected to begin soon.. Masse said Sinclair dug trenches at the site to drain wetlands and marshes, knowing the toxin-contaminated sediments would end up in the Bay of Quinte.
